Introduction

In accordance with the General Data Protection Regulation (‘GDPR’) and Law 3/2018 on Protection of Personal Data and Guarantee of Digital Rights (‘LOPDGDD’), PONS IP, S.A. (hereinafter, ‘PONS IP’) sets out this Privacy Policy to inform you clearly and transparently about how we collect and process your personal data through the Website https://ponsip.com/ (hereinafter, the ‘Website’).

When an interested user or potential client fills out forms on the Website requesting information, such as for ‘IP Evaluator ‘ or ‘Shall we talk about your Project ”.

Processing Duration. Retention of personal data. 

We shall store the personal data provided for the time strictly necessary to fulfill each of the purposes foreseen. Specifically:

  • Data relating to browsing on the Website: We shall store the data collected through the use of Cookies in the aforementioned terms, for the term established in the Cookie Policy (LINK).
  • Data relating to event registration: We shall store the data necessary for event registration for the duration of the event. After the event has ended, we shall store the data for the time strictly necessary to comply with the applicable legal obligations.
  • Contact data and data required to send commercial communications (Newsletter): We shall store this data until your consent for the sending of electronic commercial communications and Newsletter is revoked.
  • Data relating to the contractual relationship (Execution of a contract): Until the contractual provision is fulfilled, including the statute of limitations for the enforcement of contractual or pre-contractual liabilities.
  • Data relating to Website content exclusive for clients: Until the end of the contractual relationship between the Client and PONS IP. 
  • Data relating to interested users (potential clients): Until the pre-contractual service requested by the interested party is executed. 
  • Data relating to candidates for jobs at PONS IP: Personal data shall be kept for a maximum period of two (2)  years from the receipt of the curriculum by the Data Subject, unless they authorize the retention of their data for longer.

 

International communication and transfer of personal data

PONS IP shall not disclose the personal data processed to any third party, except at the express request of a court or request from the law enforcement authorities.

PONS IP may internationally transfer your data to countries whose level of protection is not equal to that of the European Union. Specifically, to the extent required by the contract for the provision of services concluded with the Controller, your personal data may be transferred to countries such as China, Colombia and the United States of America, where PONS IP has commercial representative offices. Likewise, as a consequence of the services that the Data Subject requests from us, it is possible and necessary that we transfer your personal data to other intellectual property agencies or specialized law firms in order to fulfill the contractual or pre-contractual services agreed upon. The level of protection for personal data in those other countries where these agencies and law firms are located may not be equal to the level of protection in the European Union.

Rights regarding the personal data processing 

The User (Data Subject) has the following rights in relation to the processing of their personal data:

  • Right to request access to the personal data;
  • Right to request rectification or erasure;
  • Right to request limitation / restriction of their processing;
  • Right to object to processing;
  • The right to the portability of the data in question, and
  • Right to revoke consent at any time.

Such rights may be exercised in several ways:

  • By sending a written communication to the postal address of the Controller.
  • By sending an e-mail to rgpd@ponsip.com.

The exercise of the aforementioned rights shall comply with the procedure set forth in the applicable regulations, either the General Data Protection Regulation, or the national legislation issued on the occasion of its incorporation into our legal system.

Additionally, the User (Data Subject) shall be able to fill a claim to the Spanish Data Protection Agency through its website: www.aepd.es.
