As we advanced a few months ago, the European Union Withdrawal Agreement regulating the details of the exit from the United Kingdom established a transitional period that ends on December 31, 2020.
During this period, new European Union trademark and design applications would continue to affect all European Union countries, including the United Kingdom, if they are granted during this period. Thus, trademarks and designs registered in the EU on January 1, 2021, will automatically be protected in the United Kingdom without the need to carry out any type of management or incur additional costs. On the contrary, if the trademarks and designs are in the process of being registered on January 1, 2021, it will be necessary to specifically request their registration in the United Kingdom in parallel to obtain adequate protection and security in this territory. Therefore, from PONS IP we are at the disposal of our clients to carry out this double registration application in the necessary cases, offering a series of special conditions both for the assessment and evaluation of the trademark portfolio and for the management of the applications, to minimize the additional costs derived from this situation. If you have any queries regarding the status of your Community trademark/design or to find out the conditions under which your registration application can benefit in these circumstances, you can contact us at the following address brexit@ponsip.com or by contacting your usual advisor. |
